 (PA ACT 15) & ITS IMPACT ON VOLUNTEERS IN THE
MINSI TRAILS COUNCIL

The Commonwealth of Pennsylvania enacted the Child Protective Services Law in 2015. The intent of this law is to protect the youth of Pennsylvania. All youth serving organizations within the Commonwealth are covered under this law. Volunteers, registered and unregistered, in the Minsi Trails Council are affected in two ways; we are mandated child abuse reporters and required to provide background check clearances to the volunteering organization.

Who is required to comply with the Pennsylvania Volunteer Law? Frequently Asked Questions

  • Adult definitions
    • Volunteer: Act 15 required
      • 18 years of age and older, not a program participant.  
      • 18 – 20 year old registered in a Scouts BSA Unit.   
    • Program Participant: Act 15 not required
      • 18 years of age and older who are registered as participants in a BSA program.  Examples are Scouts BSA, Exploring, Venturing, Sea Scouts.  
  • General Guidelines
    • Act 15 Clearances are required if a carpool is organized or drivers are recruited by the unit’s leaders. If organized guardian / parent to guardian / parent the clearances are not needed.
    • Guardians / Parents helping with fundraisers – if the parent will be or could be responsible for a child other than their own then Act 15 clearances are required.
    • Clearances are not required for guardians / parents who stay occasionally at a meeting, unless their participation becomes supervisory of youth.
    • Renewals of PA Act 15 Clearances
      • All clearances are valid for 60 months from the initial request date (inception date).
      • Child Abuse History Clearance, the renewal window starts on the day after the 57th month.
      • Criminal History from PA State Police, the renewal window starts on the day after the 57th month.
      • Finger based FBI Criminal History Clearance, fees apply regardless of renewal window.
        • Disclosure Statement and Waiver Application, renewal window any time.

  2. Pennsylvania State Police Criminal Record Check
  3. Federal Bureau of Investigations (FBI) Criminal History Background Check (required for all employees and some volunteers) Volunteers use code: 1KG6ZJ 

OR

  1. Council PA Resident Volunteer Waiver for Volunteers who have resided in the Commonwealth of PA for the past 10 years, can submit the Disclosure Statement for Volunteers in lieu of the Fingerprint based FBI Clearance.

Existing volunteers must secure and provide the following clearances to Minsi Trails Council

  1. Pennsylvania Child Abuse History Clearance
  2. Pennsylvania State Police Criminal Record Check
  3. Federal Bureau of Investigations (FBI) Criminal History Background Check (required for all employees and some volunteers) Volunteers use code: 1KG6ZJ 

OR

  1. Council PA Resident Volunteer Waiver for Volunteers who have resided in the Commonwealth of PA for the past 10 years, can submit the Disclosure Statement for Volunteers in lieu of the Fingerprint based FBI Clearance.

An adult who has applied for an unpaid position as a volunteer with the Boy Scouts of America, in your position, you are neither responsible for the welfare of a child nor have direct volunteer contact with children and therefore, not required to obtain the PA Mandated Background Checks.

Neither of the following are part of your responsibilities:

  • Acting in lieu of or on behalf of a parent (at no point am I the person in charge of children).
  • Providing care, supervision, guidance or control of children and having regular and repeated contact that is integral to my volunteer responsibilities.  (I do not attend camping trips as a leader or assist at more than 3 meetings or activities with Scouts per year.)

You affirm that:

  • I do not present myself as a leader or authoritative figure in the Boy Scouts of America.
  • If I wear the Scout uniform, it is only for ceremony and not to represent authority.
  • Understand and have completed the Disclosure Statement Application for Volunteers not subject to the PA Mandated Background Checks.

Should your participation, position or responsibilities change, requiring you to obtain the PA Mandated Background Checks, you realize you must submit those certifications to Minsi Trails Council, Boy Scouts of America, before assuming the new position or responsibilities.

Please turn in your Disclosure Statement to the Minsi Trails Council Registrar. 

If, you have completed an application for your youth to join as a Lion or Tiger Scout, you are considered a Adult Parent Partner.  

  • Lion Adult Partners – Clearances are NOT required for Lion Adult Partners as they are participating in the BSA program as parents. Clearances ARE required for Lion Den Leaders.
  • Tiger Adult Partners – Clearances are NOT required for Tiger Adult Partners as they are participating in the BSA program as parents. Clearances ARE required for Tiger Den Leaders.

If, your participation changes to one of the following below, you then are required by law to secure clearances.  Definition: Acting in lieu of or on behalf of a parent (at no point am I the person in charge of children). Or providing care, supervision, guidance or control of children and having regular and repeated contact that is integral to my volunteer responsibilities.  

  • Lion, Tiger, Wolf, Bear, or Webelo Den Leader or Assistant Den Leader.  Take on a leadership role; Committee Chair, Cubmaster, Assistant Cubmaster, Committee Member.
  • At a Minsi Trails Council owned Summer Resident Camp.  
    • This includes Camp Minsi – clearances ARE REQUIRED of parents/guardians who attend camp as volunteers, as they may be acting in lieu of a parent and will have routine interaction and direct contact with youth.
  • Drivers to camps or events or unit meetings
    • If a parent asks another parent (parent to parent) to drive their son to an event or camp or meeting then clearances are NOT required.
    • If however, a carpool is organized or drivers are recruited by the unit’s leaders, then clearances ARE REQUIRED.
  • Parents helping with fundraisers (Show and Sell and/or store front sales) – if the parent will be or could be responsible for a child other than their own son (or daughter) then clearances ARE REQUIRED.

New volunteers must secure and provide the following clearances to Minsi Trails Council

As an employee of Minsi Trails Council – Camp Staff, you are required by law to secure and provide the following clearances to Minsi Trails Council.

  1. Pennsylvania Child Abuse History Clearance
  2. Pennsylvania State Police Criminal Record Check
  3. Federal Bureau of Investigations (FBI) Criminal History Background Check use code: 1KG738

OR

  1. Disclosure Statement Application for Employment of a Minor only for minors under 18 who have been a resident for 10 years or more.

We will reimburse the cost for any 2025 clearances.  Submit original receipts with copies of clearances.

  • Clearances must state for Employment, not Volunteering. Clearances are good for 5 years.
  • Your clearances must have been completed between August 31, 2020 through August 31, 2025.
  • If they expire before August 31st then you must submit new clearances. 

Frequently Asked Questions

Some of the clearances come back within a few minutes, however some may take as long as 4-6 weeks.

As per Pennsylvania law, all new employees must secure their clearances prior to employment in any capacity.

As a 14 years of age and older (CIT) or Volunteer, you must secure and provide updated clearances to Minsi Trails Council

  1. Pennsylvania Child Abuse History Clearance
  2. Pennsylvania State Police Criminal Record Check
  3. Federal Bureau of Investigations (FBI) Criminal History Background Check (required for all employees and some volunteers). Volunteers use code: 1KG6ZJ

OR

  1. Council PA Resident Volunteer Waiver for Volunteers who have resided in the Commonwealth of PA for the past 10 years, can submit the Disclosure Statement for Volunteers in lieu of the Fingerprint based FBI Clearance.
